1. USE OF THE WEBSITE
By using this site, you, the user, are accepting these terms and conditions.
The user on SingTel Mobile's record will be responsible for all transactions, regardless of whoever is making the purchase online. If you are below the age of 21, and using your parent/guardian's number, you are advised to get consent before making purchases.
SingTel Mobile reserves the right to update these Terms and Conditions from time to time.
2. DEFINITIONS
'Order Number: A string of 5 alphanumerical characters given to the user upon game purchase.
Physical Boxset Games: Titles purchase from GXStore Games Delivery, that will be delivered to you, not digital downloads.
Game Publisher: the proprietary owner of the game offered at the website.
Pre-order: allows you to buy the game first, and will be delivered to you, once it has been released. Release dates may vary depending on the game.
GST: Tax that is chargeable under the Goods and Services Tax Act (Cap 117A) of Singapore on the supply of goods and services in Singapore and the importation of goods into Singapore
SMS Content: refers to short message service offered by SingTel Mobile to its subscribers
User Name: A unique name registered by the User to be used in the respective Games accessed via a network on a personal computer
Website: the site where GXStore is located, in this case http://www.gx.com.sg/GXStore.
3. PURCHASE OF PHYSICAL BOXSET GAMES from GXSTORE GAMES DELIVERY
3.1 The User triggers SMSes on purchase of Physical Boxset Games via GX.com.sg.SMS charges will be imposed by SingTel Mobile on the subscriber based on the price plan of the subscriber at the time of transmission of the SMS.
3.2 Charges for the Physical Boxset Game will be reflected in the subscriber's SingTel Mobile bill. All prices of the Physical Boxset Game are inclusive of prevailing GST unless otherwise stated.
3.3 Physical Boxset Game, once purchased, shall not be refundable or exchangeable.
3.4 User is responsible for the security and proper use of the SMS Content. It’s to be kept confidential, secure, used properly and not disclosed to unauthorised persons. User is responsible for all activities, whether authorised or unauthorised, that occur with the usage of the SMS Content.
3.5 User hereby acknowledges that Pre-order purchase is subjected to the various shipment conditions of the game title which includes variables such as expected arrival date in Singapore & game title quantity.
3.6 User is solely responsible for the understanding, interpretation and application of the rules, playing methods or procedures or any other content set out in the Physical Boxset Game in accordance with the rules set out by the game developer. SingTel Mobile shall not entertain any claims by the User that the rules were not clear or that the User misinterpreted the rules used in error or otherwise whatsoever.
3.7 User hereby acknowledges that use of Physical Boxset Game may be subject to further terms and conditions imposed by the Game Publisher. User agrees to accept such terms and conditions stipulated by the Game Publisher from time to time.
3.8 Should there be matters of game titles being out-of-stock & delivery arrangement issues, we will endeavor to provide the best alternative arrangement.
4. COMPETITIONS AND PRIZE DRAWS
From time to time SingTel Mobile may run competitions, free prize draws and promotions on the Website. These will be subject to additional terms and conditions that will be made available at the time of such competitions. SingTel reserves the right to amend and/or remove the promotion and associating terms and conditions at its discretion.
5. INTELLECTUAL PROPERTY RIGHTS
5.1 All Games including graphics, audio and video, pictures, drawings, names, logos, material or content capable of intellectual property rights protection displayed or available through the Website are protected by law and shall belong to its lawful owner. The User shall not copy, download or otherwise misuse or infringe the intellectual property rights contained therein.
5.2 The User shall indemnify SingTel Mobile and/or its related companies for any claims, demands, suits, loss or damages, costs and expenses (including legal costs) arising from breach of clause 5.1 by the User or from any act or omission of the User in the use of the Website and/or the Games and its related services.
6. LIMITATION OF LIABILITY
6.1 The accessibility and operations of the Physical Boxset Games and its related services rely on technologies outside of SingTel Mobile's control. SingTel Mobile does not guarantee continuous accessibility or uninterrupted operation of the Physical Boxset Games and/or its related services.
6.2 Internet communications may be susceptible to interference or interception by third parties. SingTel Mobile makes no warranty that the Website and/or Physical Boxset Games are free from attack by computer viruses or other unauthorized software.
6.3 SingTel Mobile shall not be liable for any loss, damages, costs, expenses whatsoever suffered or incurred by the User which may arise (whether in contract, tort, including negligence under statute or otherwise) by reason of or in connection with the provision of the Website and the Physical Boxset Games any limitations described in clauses 6.1 and 6.2 above or any other cause not specifically set out herein.
6.4 To the extent permitted by law, SingTel Mobile excludes all warranties, rights and remedies (including warranties implied by statute or otherwise) that the User would otherwise be entitled to by law.
7. MISCELLANEOUS
7.1 These Specific Terms and Conditions shall be subject to and construed in accordance with the laws of the Republic of Singapore and the User hereby agrees to submit to the exclusive jurisdiction of the Courts of the Republic of Singapore.
